Break Out the Shovels and Ice-Melt - The Massachusetts Real ...

Ice slip drinkThe first major winter storm in Massachusetts yesterday brought lots of questions on Massachusetts snow and ice removal law.

I am a homeowner and rental property owner. Am I legally required to clear snow and ice after a storm?

The law now in Massachusetts is that?all Massachusetts property owners and landlords are legally responsible for the removal of snow and ice from their property.?In 2010, the Massachusetts Supreme Judicial Court overruled 125 years of legal precedent which protected property owners from ?natural accumulations of ice and snow,? and announced this new rule. My prior post on the case can be read here. The rule applies across the board, to homeowners, landlords, commercial business owners, restaurants, everyone.

I am a landlord. How long do I have to shovel snow and ice on my rental property?

There is no clear cut answer to this question, and juries and courts will ultimately decide what is reasonable. The City of Boston?s policy is to give businesses 3 hours to clean snow, and 6 hours to residents. My advice is to shovel and treat snow and ice early and often. Even a thin coating of black ice can cause someone to slip and fall and seriously hurt themselves. (Admit it if you?ve dumped on your rear end like I have!). If you are an out-of-town landlord, you must hire someone to shovel your snow.

My lease states that the tenant is responsible for snow shoveling. Will that protect me from liability?

Probably not. A person who is injured due to untreated snow or ice will likely sue both the property owner and the tenant. The property owner must ultimately ensure that the property is safe for visitors. The landlord may bring a claim for contribution/indemnification against the tenant.

I live in Boston, and I heard I have to shovel the public sidewalk in front of my house after a storm. Is that true?

Yes. On top of their added responsibilities, property owners in several Massachusetts communities, including Boston, Newton, Lynn, and Worcester, are required by local ordinances to clear municipal sidewalks in front of their residences or businesses. The City of Boston mandates clean sidewalks within 6 hours of a storm; Worcester is 12 hours.

Will my homeowner?s or CGL insurance policy cover any injuries from slip and fall on snow/ice?

Yes, usually. The standard Massachusetts homeowners insurance policy and commercial general liability insurance policy (CGL) will have liability coverage for slip and falls on property. Make sure you have ample liability coverage of at least $500,000 to 1 Million. (You can never have enough insurance!). As with any insurance question, it?s best to contact your personal insurance agent.

    Margaret Paul, Ph.D.: 5 Choices to Help You Stay in Love

    We all know that being in love is one of the very best feelings in the world. When we fall in love, we often believe that our in-love feelings are going to last forever.

    In my counseling practice, I've worked with countless people who believed that, this time, the love would last.

    Take Benjamin, for example. Benjamin had been married for 22 years when he decided to divorce his wife. He was tired of not feeling connected and intimate with her. He experienced her as closed and resistant, and he wanted a relationship with an open woman.

    Soon after the divorce, Benjamin met Rachel at the home of a friend. They connected immediately. Benjamin called me, ecstatic. "I know it's really early in this relationship -- we've only known each other a couple of weeks, but I think I'm in love. It feels so good to be with an open and caring woman."

    "Benjamin, please take your time. You are just out of a long marriage and you have barely settled into your new life. It really does take time to know someone. I'm glad you and Rachel are enjoying your time with each other, but please don't rush into anything."

    I knew this was likely to fall on deaf ears. I've seen it so many times.

    Two months after meeting, the bloom was off the rose.

    "Rachel runs away when she is upset. It's frustrating to me to not be able to work things out with her. And she doesn't take good care of herself in a lot of ways. She takes care of everyone but herself."

    Benjamin very much wanted to be in love, but he had not made the choices that would lead to lasting love.

    Five Choices to Help You Stay in Love

    1. Learn to love yourself

    Do the inner work you need to do to be happy on your own. If you are abandoning yourself by not taking responsibility for your feelings, judging yourself, turning to various addictions, or making someone else responsible for making you feel full, loved, safe and adequate, you will meet someone who is also abandoning themselves in various ways. We meet each other at our common level of self-abandonment or health, so do the work you need to do to feel happy, peaceful and full of love inside. You don't need to be fully healed, as much healing can take place within a relationship, but you do need to know how to love yourself so you can share your love with others.

    2. Take it slow

    One of the major mistakes that many people make is moving too fast -- including having sex too early. For a sexual relationship to be deeply satisfying on the physical as well as on the emotional level, there needs to be deep caring and connection. Early "in-love" feelings are often nothing more than infatuation, as truly being in love happens over time -- if it is going to happen. If someone is rushing you into a relationship, be very cautious. Behind the beautiful words and dazzling pursuit may lurk neediness and narcissism.

    3. Ask in-depth questions

    Ask the important questions -- about values, money, children, religion/spirituality, past relationships. If you are afraid to be forthright in your questions, then the fear itself is letting you know that your fear of rejection may be in charge -- which means you have more inner work to do.

    4. Don't shy away from conflict

    All relationships have some conflict, and much can be learned from how you each deal with conflict. If you are avoiding the important questions, giving yourself up to keep the peace, or not speaking up for yourself, you will not learn what you need to regarding how the two of you handle conflict. If your new love closes down, gets angry or furious, goes into resistance or defensiveness, or turns to an addiction, this does not bode well for staying in love. An inability to resolve conflict is a major reason why in-love feelings fade away.

    If your new love briefly does these protective behaviors, but then opens to learning with you, great. But if he or she does not open within the same day as the conflict, then it will be very hard for issues to get resolved between you.

    5. Appreciation rather than judgment

    You are not likely to fine someone who has everything you want, but hopefully he or she has many of the qualities you value. Instead of focusing on what you don't like and trying to change your partner with judgment, appreciate what is wonderful about your new love. This doesn't mean avoiding problems, as it is vital to explore the difficulties -- with an intent to learn -- but being judgmental is one of the quickest ways to put the lid on love.

    While you will not always feel "in love" with your partner, following these five choices will give you a very good chance of feeling loving and connected with your partner much of the time.

    Week's second snow storm expected to be milder

    NEW YORK (AP) ? Snow from a mild but widespread winter storm began falling Saturday over most of the Northeast and the upper Ohio River Valley, the second in less than a week for the regions.

    Forecasters expected the heaviest snowfall of up to 8 inches in southern New England, including Boston and Providence, R.I., by late Saturday. Farther south, New York City and Philadelphia saw a mix of rain and snowfall as the storm moved in from the west. A few inches of snow were forecast.

    "Expect those accumulations to kind of work their way northeastward through much of New York state and much of New England," said meteorologist Brian Hurley of the National Weather Service.

    About 20 vehicles piled up in a storm-related chain-reaction crash on Interstate 93 in New Hampton, N.H., police said, and five people were injured.

    Drivers throughout the regions were warned to be cautious. Officials lowered the speed limit to 45 mph on much of the Pennsylvania Turnpike, about 300 miles from the Ohio state line to east-central Pennsylvania.

    Flights at Philadelphia's airport were delayed about an hour, mostly arrivals, spokeswoman Stacy Jackson said.

    Parts of southern Indiana saw 6-8 inches from the storm, some in areas that had received more than a foot from a blizzard earlier in the week.

    That blizzard was part of a storm system that dumped more than a foot of snow in some places and has been blamed for at least 16 deaths. It also spawned more than a dozen tornadoes in Alabama, the National Weather Service said.

    But Saturday's snow "shouldn't be as heavy with the previous storm," weather service meteorologist Marty Rausch said.

    Gay marriage law goes into effect in Maine

    PORTLAND, Maine (AP) ? Chris Kast and Byron Bartlett already consider themselves married after a 2010 ceremony overlooking Portland Harbor, but now they're doing it all over again ? planning to be among the first to get a marriage license now that Maine's same-sex marriage law has taken effect.

    Portland City Hall opened at midnight to issue the first marriage licenses under the new law. There were free carnation boutonnieres, and a jazz trio played.

    Voters approved gay marriage in November, making Maine and two other states the first to do so by popular vote. The law is already in effect in Washington state; Maryland's takes effect on Tuesday, the first day of 2013.

    Gay marriage was already legal in New York, Connecticut, Iowa, Massachusetts, New Hampshire, Vermont and the District of Columbia, but those laws were either enacted by lawmakers or through court rulings.

    Kast and Bartlett were among about a dozen couples waiting in line at Portland City Hall. With their four daughters home for the holidays, the couple decided they would wed on the spot after getting their marriage license. They didn't see the need for another big ceremony.

    "This is putting a period on an important sentence for us," said Kast, 52, who has been with Bartlett, 42, for more than six years. "We're going to finish it, and put it behind us."

    The Maine Legislature had once approved same-sex marriage, but it was overturned by a statewide referendum three years ago, crushing couples who had already made wedding plans. Gay marriage supporters collected signatures to put it on the ballot again, and this time it was easily approved.

    Gov. Paul LePage signed off on the certified election results on Nov. 29, so the new law was to go into effect 30 days from that date. In addition to gay marriage becoming legal, same-sex marriages in other states will now be recognized by the state of Maine.

    Nobody knew exactly how many couples would be rushing to get their marriage licenses early Saturday. Falmouth joined Portland in opening at midnight. A handful of other communities including Bangor, Brunswick and Augusta planned to hold special Saturday hours.

    Suzanne Blackburn and Joanie Kunian, of Portland, were among those in line to get their license at midnight, but they didn't plan to wed immediately. One of their grandchildren wanted them to get married on Valentine's Day.

    "I don't think that we dared to dream too big until we had the governor's signature," Blackburn said. "That's why it's so important, because it feels real."

    India gang-rape victim 'struggling' to survive, hospital says

    SINGAPORE -- An Indian gang-rape victim whose assault in New Delhi triggered nationwide protests earlier this month has suffered "significant brain injury" and is surviving against the odds, the Singapore hospital treating her said on Friday.

    The 23-year-old medical student, who was severely beaten, raped for almost an hour and thrown out of a moving bus in New Delhi, was airlifted to Singapore on Dec. 26 for specialist treatment.

    "The patient is currently struggling against the odds, and fighting for her life," Mount Elizabeth Hospital Chief Executive Officer Kelvin Loh said in a statement.

    "Our medical team's investigations upon her arrival at the hospital yesterday showed that in addition to her prior cardiac arrest, she also had infection of her lungs and abdomen as well as significant brain injury."

    The victim had already undergone three abdominal operations before arriving in Singapore, where her condition on Thursday was described as "extremely critical."

    Demonstrations over the lack of safety for women erupted across India after the Dec. 16 attack on the unnamed victim, culminating last weekend in pitched battles between police and protesters in the heart of the capital.

    Should the woman die, it could trigger fresh outrage over the case, which caught Prime Minister Manmohan Singh's government off guard and triggered a blame game between politicians and the police.

    "We share the anguish and anger with the country over this heinous crime," Singh told reporters on Friday. "Our prayers are with the brave young girl and best possible medical care is being provided to her."

    New Delhi has the highest number of sex crimes among India's major cities, with a rape reported on average every 18 hours, according to police figures. Government data show the number of reported rape cases in the country rose by nearly 17 percent between 2007 and 2011.

    Protests continued across New Delhi, India, where around 500 people marched in response to the recent gang rape of a young woman. NBCNews.com's Dara Brown reports.

    A landmark Environmental Protection Agency report concluding that children exposed to toxic substances can develop learning disabilities, asthma and other health problems has been sidetracked indefinitely amid fierce opposition from the chemical industry.

    America?s Children and the Environment, Third Edition, is a sobering analysis of the way in which pollutants build up in children?s developing bodies and the damage they can inflict.

    The report is unpublished, but was posted on EPA?s website in draft form in March 2011, marked ?Do not Quote or Cite.? ?The report, which is fiercely contested by the chemical industry, was referred to the White House Office of Management and Budget (OMB), where it still languishes.

    For the first time since the ACE series began in 2000, the draft cites extensive research linking common chemical pollutants to brain damage and nervous system disorders in fetuses and children. ?It also raises troubling questions about the degree to which children are exposed to hazardous chemicals in air, drinking water and food, as well exposures in their indoor environments ? including schools and day-care centers ? and through contaminated lands.

    In the making since 2008, the ACE report is based on peer-reviewed research and databases from federal agencies, including the Food and Drug Administration, Housing and Urban Development and the Centers for Disease Control and Prevention. ?Public health officials view it as a source of one-stop shopping for the best information on what children and women of childbearing age are exposed to, how much of it remains in their bodies and what the health effects might be. Among the ?health outcomes? listed as related to environmental exposures are childhood cancer, obesity, neurological disorders, respiratory problems and low birth weight.

    The ?EPA?s website still notes that the report will be published by the end of 2011. ?But after a public comment period that was marked by unusually harsh criticism from industry, additional peer review and input from other agencies, the report landed at OMB last March, where it has remained. No federal rule requires the OMB to review such a report before publication, but an EPA spokeswoman said the EPA referred it to the OMB because its impact cuts across several federal agencies.

    The spokeswoman said the agency had no idea when OMB would release it, allowing publication. ?Neither agency would discuss what changes had been made to the draft.

    Some present and former EPA staffers, who asked not to be named for fear of losing their jobs, blamed the sidetracking of the report on heightened political pressure during the campaign season. ?The OMB has been slow to approve environmental regulations and other EPA reports throughout the Obama Administration ? as it was under George W. Bush, according to reports by the Center for Progressive Reform, a nonprofit consortium of scholars who do research on health, safety and environmental issues.

    ?Why is it taking so long? One must ask the question,? said a former EPA researcher who works on children?s health issues. ?It is an important document and it strikes me that it?s falling victim to politics.?

    The EPA states that the report is intended, in part, to help policymakers identify and evaluate ways to minimize environmental impacts on children. That?s an unwelcome prospect to the $674 billion chemical ?industry, which stands to lose business and face greater legal liability if the EPA or Congress bans certain substances mentioned in the report or sets standards reducing the levels of exposure that is considered safe.

    Among other findings, the report links numerous substances to ADHD, including certain widely available pesticides; ?polychlorinated biphenyls ?(PCBs), which were banned in 1979 but are still present in products made before then and in the environment; certain polybrominated diphenyl ethers (PBDEs), used as flame retardants; and methyl mercury, a toxic metal that accumulates in larger fish, such as tuna. The draft also cites children?s exposure to lead, particularly from aging lead water pipes, as a continuing problem (See?Toxic Taps.)

    Two new species of orchid found in Cuba

    Dec. 27, 2012 ? Researchers from the University of Vigo, in collaboration with the Environmental Services Unit at the Alejandro de Humboldt National Park (Cuba), have discovered two new species of Caribbean orchid.

    The Caribbean islands have been natural laboratories and a source of inspiration for biologists for over two centuries now. Suffice to say that the studies by Charles Darwin and Alfred Russel Wallace in the tropical archipelagos contributed to the emergence of the theory of evolution.

    In this case, a Spanish research team from the University of Vigo has discovered two new species belonging to the orchid family (Orchidaceae: Laeliinae) in Cuba. They have been called Tetramicra riparia and Encyclia navarroi. The two plants were found in the eastern and western zones of the island respectively.

    "The first species described, Encyclia navarroi, is an orchid with considerably large flowers. A year later we discovered the Tetramicra riparia species, with very small flowers. The latter is so named because it grows on the banks of stony streams in the mountains of Baracoa, one of the rainiest and least explored areas in Cuba," as ?ngel Vale explained. Vale is a researcher at the University of Vigo and co-author of the studies published by the journals Systematic Botany and Annales Botanici Fennici.

    Darwin was very much drawn to the orchid family, and used it to propose certain hypotheses about the importance of the relations between flowers and pollinators for biodiversity. Between 25,000 and 30,000 species of these plants are estimated to exist. However, the mechanisms that explain this amazing variety are only now being discovered.

    "We could highlight their extraordinary capacity to interact with different types of pollinators. Contrary to most plants, many orchids do not produce nectar or other substances to compensate insects and birds that visit them," explained the researcher.

    Orchids' deceit pollination

    Despite this, floral visitors are attracted by orchids' colours and shapes, which enables the plants' sexual reproduction. This is known as deceit pollination.

    The University of Vigo Plant Ecology and Evolution research team, which Vale belongs to, is studying the ecological and evolutionary consequences of deceit pollination in orchids that are endemic to the Greater Antilles: Cuba, Jamaica, Hispaniola and Puerto Rico. One of the mysteries they aim to solve is if the deceit orchids have a greater taxonomic and genetic diversity than other nectar-producing species.

    Vale and his team are drawing up studies in the Antilles not only to reconstruct the evolutionary history of orchids but also to analyse the effect of pollinators in the reproduction of plants, and how this interaction has modelled the colourful aspect of these Caribbean flowers.

    "Despite the fact that T. riparia's flowers have a complete central petal, just like other species that make up a subgenre endemic to Cuba; the way they grow is very similar to a more widespread group that seems to have diverged on the neighbouring island of Hispaniola. Our work provides molecular evidence of the greater relationship of T. riparia with these species on the neighbouring island.     BERLIN - As a capital city, Berlin has endured more than its fair share of division over the years.?Now new battle lines are being drawn over what some see as a fight for the city's character.

    The conflict began when City Hall announced?its intention to phase out the vast majority of Berlin's historic gas lamps?as?part of an ambitious project to make the city carbon-neutral by 2050.

    With nearly 43,000 gas-powered streetlights, Berlin has more than any other city in the world. In fact, more than one in six in the city are gas.

    Some date back to the 19th century; others were erected immediately after World War II as the occupying Soviet forces made restoring light to the devastated city a priority.

    In recent years, guided tours have been run to picturesque areas, with sightseers attracted by the?distinctive warm, yellowish glow of gas lamps.

    With nearly 43,000 gas-powered street lamps, Berlin has more than any other town or city in the world.

    Pollution, expense
    Think Beacon Hill in Boston or San Diego's Gaslamp Quarter - but on a much larger scale - and cue the outrage.

    But with annual running costs for fuel and maintenance as much as $700 for some lamp models, and carbon dioxide emissions almost ten times that of an equivalent electric light, there are now strong financial and environmental incentives to replace gas with electric alternatives.

    City authorities say the figures speak for themselves.

    ?The energy used by those 8,000 gas lamps could power 100,000 electric lights.?And replacing them would cut energy costs by 90 percent, reduce carbon dioxide emissions by 9,200 tons per year and save a chunk of the $1.6 million spent each year just on replacement gas mantles.

    Petra Rohland, spokeswoman for Berlin's Department of Urban Development, said the current refit would be complete by end of 2016 - and would recoup the cost within nine years.

    All but a few of the city's gas-powered lamps will eventually go.

    "Five percent of the historic gas lights, especially the candelabra, will be kept as originals in the future," Rohland said.

    'Knock down the Brandenburg Gate'
    It's a future that fills some Berliners like Paul Harrison with dread.

    Harrison is a member of a growing band of preservation societies?who oppose the wholesale replacement of gas lights.

    He challenges the environmental and financial arguments put forward by the city to justify the changes.

    "If we're just talking about saving money, we could knock down the Brandenburg Gate," he said ironically. "After all, that costs a lot to keep going, to keep clean."

    Harrison's group, Gaslight Culture, is calling for the dismantling to be suspended - and for talks between all interested parties.

    "It's so very difficult to work with," Braun said. "The extremes of temperature make it a constant battle ... unlike electricity, which is a dead light, gas gives a living light. But that's tough to recreate in an LED."

    "Some people think I'm crazy to spend all this time trying to replicate the look of the gas lamp," he said. "But they are beautiful; gas lights have no glare, you can look right into them."

    Johnson sets NFL season record for receiving yards

    Lions coach Jim Schwartz said surpassing Rice was a great achievement.

    "To break a record by a guy who is maybe the greatest player ever to play in the National Football League says a lot about what he accomplished," Schwartz said, adding: "His best is yet to come."

    Johnson also set an NFL record by gaining more than 100 yards receiving for an eighth straight game.

    It was Johnson's 11th game this season with at least 100 yards receiving, matching the NFL mark achieved in 1995 by Michael Irvin of the Dallas Cowboys.

    After the game, Falcons quarterback Matt Ryan sought out Johnson on the field. "I congratulated him," Ryan said. "I'm a fan."
